Waiver
By requesting and accepting face masks through the this Website ( https://nancyarico.wixsite.com/smilesunmasked) and/or Smiles UNmasked (“Face Masks”), you agree with the following terms:
◦ You agree that you are the end user of each requested Face Mask and/or are requesting Face Masks on behalf of an organization or facility that will be the end user. You agree that each Face Mask requested and accepted will be used only for personal use and will not be used in connection with any medical care or as a substitute for any other product.
◦ You agree that you have read the Instructions for Wearing and Product Details listed above and understand each statement included in those sections.
◦ You agree that, by requesting and accepting Face Masks through this Website and/or Smiles UNmasked, you release and agree not to sue JuntoSpace and/or Smiles UNmasked, or its volunteers, officers, directors, employees, sub-contractors, sponsors, agents and affiliates (“Smiles UNmasked”) from all present and future claims that may be made by you, or your family, estate, heirs, or assigns, for property damage, personal injury, or wrongful death arising as a result of your request for, acceptance of, or use of Face Masks, regardless of circumstance. You understand and agree that Smiles UNmasked is not responsible for any injury or property damage arising out of your request for, acceptance of, or use of Face Masks, even if such injury or damage is caused by ordinary negligence or otherwise. You understand that the use of Face Masks involves certain risks, including but not limited to product failure and the inability of the Face Mask to protect you from COVID-19. You are voluntarily requesting, accepting, and using Face Masks with knowledge of the danger involved and you agree to accept the risks associated with such use. You also agree to indemnify and hold harmless Smiles UNmasked for all claims arising out of your request for, acceptance of, or use of Face Masks. You understand that this agreement is intended to be as broad and as inclusive as permitted by the laws of the state in which you use the Face Masks and agree that if any portion of this agreement in invalid, the remainder will continue in full legal force and effect.
